La nueva modalidad de jubilación : La JUBILACIÓN ACTIVA consiste, en términos generales, en percibir el 50% de la pensión (excluido en su caso el complemento por mínimos) y continuar trabajando ya sea a media jornada, a jornada completa y ya sea como trabajador por cuenta propia como por cuenta ajena. El requisito principal es que el porcentaje aplicable a la base reguladora de la pensión sea del 100. Quedando excluidas las siguientes situaciones: El régimen de clases pasivas del estado, las jubilaciones acogidas a bonificaciones y las jubilaciones anticipadas que pudieran ser de aplicación al interesado. En el caso de trabajadores por cuenta ajena, la empresa tiene unos requisitos adicionales como son: Mantenimiento del empleo durante la percepción de la pensión de jubilación compatible con el trabajo. Las empresas no pueden haber adoptado decisiones extintivas improcedentes en los 6 meses anteriores a dicha compatibilidad, debiendo mantener, durante la vigencia del pensionista de jubilación, el nivel de empleo existente en la misma antes de su inicio. Los empresarios y los trabajadores cotizarán a la Seguridad Social por incapacidad temporal y por contingencias profesionales, además de una cotización especial de solidaridad del 8 por 100, no computable para las prestaciones, que en los regímenes de trabajadores por cuenta ajena se distribuirá entre empresario y trabajador, corriendo a cargo del empresario el 6 por 100 y del trabajador el 2 por 100. En el régimen de cuenta propia asume el trabajador autónomo de forma completa el 8%. El beneficiario tendrá la consideración de pensionista a todos los efectos y una vez finalizada la relación laboral por cuenta ajena o el cese de actividad por cuenta propia se percibirá la pensión al 100%.
