Las empresas se engañan así mismas con los ERTES ¿Estamos ante una huida hacia delante?

La actual situación económica negativa y de falta de productividad por la que están atravesando muchas empresas en nuestro país ha provocado, en los últimos años, un aumento en el número de  Expedientes de Regulación Temporal de Empleo (ERTE), de Suspensión y Reducción de Jornada, planteados por las empresas. Esta cifra se ha elevado  aún más tras la reforma laboral del año 2012, que eliminó la autorización administrativa para la aplicación de los ERTES.  Pero, ¿se está utilizando correctamente el ERTE por parte de  las empresas, o su aplicación es, simplemente, una huída hacia delante de los empresarios, para no tener que tomar decisiones más drásticas y definitivas, es decir, rescisiones de contratos, y evitar con ello tener que abonar las indemnizaciones correspondientes?.

El ERTE se ha de utilizar como una medida de carácter temporal con la que conseguir  superar  una situación coyuntural de crisis, motivada por problemas  económicos, productivos u organizativos, o una combinación de ambos. En mi opinión, y por la experiencia tenida, muchos de los empresarios que aplican los ERTES se encuentran ante situaciones de crisis en las que es necesario adoptar, desde un principio, medidas definitivas y no medidas de carácter temporal. Muchas de estas empresas comienzan aplicando uno o varios ERTES, consecutivos en el tiempo. Una vez finalizados estos la situación de crisis no ha desaparecido, por lo que transcurridos tres o cuatro años desde la aplicación del primer ERTE tienen que proceder a rescindir contratos de trabajo para poder garantizar, en el mejor de los casos,  la viabilidad futura de la empresa. ¿Y que han conseguido en el tiempo de aplicación de las medidas de carácter temporal?, pues un aumento en las  indemnizaciones que tienen que abonar a sus trabajadores y unos gastos de Seguridad Social, que si se hubieran aplicado anteriormente los despidos no hubieran existido.

Las empresas no se deberían  engañar a sí mismas, intentando obtener una reducción temporal de los costes con la esperanza de que los ingresos mejoren, tendrían que empezar a  darse cuenta que las decisiones estratégicas, aunque sean desagradables,  son las que llevan a las grandes mejoras. Como diría el refrán “a veces, por ahorrarnos la peseta, perdemos el duro”.
